After the meeting, Green conducted his investigation and found out that Eric Thomas was illegally dumping hazardous waste on other people’s properties. Green then went to Thomas place to inform him about the findings and to give a cease order as well as a cleanup order. Thomas sees nothing wrong with dumping waste in that piece of land since it is adjacent to his other plot, therefore defying the Green’s orders. After the deadline, Green went to the tribal judge Richard Tallgrass to file a lawsuit with aim of having Thomas legally forced to clean up the toxic waste.
The primary issue is the illegal dumping of harmful substances by Thomas on other people’s property. The secondary issue was how Thomas reluctantly defied legal orders to clean up the harmful waste on other people’s property. There are a law enforcement agency and a sheriff’s office that ensures law and order are maintained. The tribe uses the factionalism system of leadership. The executive branch of the tribe’s council administers, legislates and controls the judicial branch.
Causes of action
The cause of action A was due to Thomas refusal to clean up the harmful dumping sites he had created on other citizen’s properties. The cause of action B was the court’s inability to punish Thomas. The cause for action C was a result of seeking justice at high levels and also a special complaint by the Carlings accusing their neighbor of dumping waste on the land. Though the two families are from the same race the accused had an influence on the board that is to resolve the matter.
In action A, Green does all the evidence and comes up with a prudent outcome which Thomas defies. In action B, Green seeks legal action from Tallgrass who assigns Steve a deputy sheriff but this does not help since his department is not responsible. Action C becomes to be worst since the accused had a powerful influence in the tribal council, this action would put the entire EPD staff in jeopardy of losing jobs.
Green’s actions were based on facts and evidence, the authority and other organs of the government ought to have acted on this fact and evidence in order to restore the beauty and value of the environment. All people in society should be treated equally regardless of their position or occupation.
